Terms of Service

1. Introduction
TenderMonitor Australia is a tender alert service operated by Reitzer-Parks Trent (ABN 40 670 532 871), sole trader, NSW 2541, Australia.
By using TenderMonitor ("the Service"), you agree to these terms. If you do not agree, please do not use the Service.
2. Eligibility
The Service is intended for businesses and individuals aged 18 or over.
3. Service description
TenderMonitor monitors the Australian Government's AusTender portal at tenders.gov.au, the NSW Government's buy.nsw portal at buy.nsw.gov.au, and the Queensland Government's QTenders portal, and sends you email and SMS alerts when newly published tenders match your keyword preferences. Standard plan subscribers receive federal tenders from AusTender only. Multi-State plan subscribers receive tenders from AusTender (federal), buy.nsw (NSW), and QLD QTenders (QLD). Both plans include AI-generated tender summaries and bid relevance scoring. SMS alerts are available on paid plans only.
4. Subscription and billing
Free trial
All new accounts start with a 7-day free Multi-State trial. No credit card is required. We will send you a reminder email on day 6 letting you know your trial is ending and what your options are. At the end of the trial, your tender alerts are paused until you choose a paid plan (Standard or Multi-State). We will never auto-convert a free trial into a paid subscription without your explicit action.
Paid plans
Paid subscriptions are billed monthly in Australian dollars (AUD) and auto-renew until cancelled. Prices shown are exclusive of GST. Applicable taxes including GST are calculated and collected by Lemon Squeezy at checkout.
Cancellation and unsubscribe
To cancel your paid subscription, use the subscription management link in your account settings (provided by Lemon Squeezy) or email hello@tendermonitor.com.au. Cancellation takes effect at the end of your current billing period. There are no cancellation fees. You retain access to paid features until the end of the period you have already paid for.
Unsubscribing from emails (via the link in any alert email) stops your tender alert emails but does not cancel a paid subscription. To stop both alerts and billing, you must cancel your subscription through Lemon Squeezy or contact us.
Refunds
If you cancel within 48 hours of a payment, you may request a refund by emailing hello@tendermonitor.com.au.
Price changes
We will give you at least 30 days written notice by email before any price change takes effect. If the price increases, you may cancel before the new price takes effect and you will not be charged the higher amount. If you do not cancel, the new price applies from your next billing cycle. Price changes do not affect your current billing period.
5. Data accuracy
All tender information is sourced from tenders.gov.au, buy.nsw.gov.au, and QLD QTenders, and published by Australian federal and state government agencies. We do not control or guarantee the accuracy, completeness, or timeliness of this government data.
You should always verify tender details, deadlines, and requirements directly on the relevant government portal (AusTender, buy.nsw, or QLD QTenders) or with the publishing agency before taking any action. TenderMonitor is a notification tool, not a substitute for your own due diligence.
6. Acceptable use
The Service is intended for business purposes. You agree not to:
- Resell, redistribute, or commercially repurpose the alert data or any content from the Service.
- Use automated tools to scrape, crawl, or bulk-extract data from the Service.
- Use the Service to send spam or unsolicited communications.
- Share your account credentials with others.
- Use the Service for any purpose that is unlawful or prohibited by these terms.
7. Intellectual property
The website design, branding, and original content of TenderMonitor are owned by TenderMonitor Australia. Tender data sourced from tenders.gov.au is subject to Commonwealth of Australia copyright. Tender data sourced from buy.nsw.gov.au is subject to NSW Government copyright. Tender data sourced from QLD QTenders is subject to Queensland Government copyright.
Your use of the Service does not grant you any intellectual property rights beyond normal personal or business use of the alerts and information you receive.
8. Limitation of liability
Our Service includes guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms limits or excludes those guarantees.
Subject to the above, and to the maximum extent permitted by law:
- We are not liable for any indirect or consequential damages arising from your use of (or inability to use) the Service, including lost profits, missed tender opportunities, or business losses.
- Our total liability for any claim related to the Service is limited to the amount you have paid us in the 12 months preceding the claim, or $100 AUD, whichever is greater.
- The Service depends on the availability of tenders.gov.au, buy.nsw.gov.au, QLD QTenders, and third-party infrastructure, which are outside our control.
9. Service availability
We aim to keep the Service running reliably, but we do not guarantee uninterrupted availability. The Service depends on tenders.gov.au, buy.nsw.gov.au, QLD QTenders, and third-party services. Occasional downtime for maintenance, upstream outages, or unexpected issues may occur.
If the Service is unavailable for more than 7 consecutive days due to a fault on our part, you may cancel your subscription and receive a pro-rata refund for the unused portion of your billing period.
10. Termination
You can cancel your account and stop using the Service at any time.
We may suspend or terminate your account for material breach of these terms. Where practicable, we will give you 7 days written notice and an opportunity to remedy the breach before termination, except where immediate suspension is necessary to prevent harm to us, other users, or third parties.
11. Changes to these terms
We may update these terms from time to time. If we make material changes, we will notify you by email at least 30 days before they take effect.
If you do not agree with the changes, you may cancel your subscription before the changes take effect and receive a pro-rata refund for the unused portion of your billing period. Continued use of the Service after changes take effect constitutes your acceptance of the updated terms.
12. Dispute resolution
If you have a complaint or dispute, please contact us at hello@tendermonitor.com.au first. We will try to resolve the matter within 14 days.
If we cannot resolve the dispute directly, either party may refer the matter to the relevant consumer tribunal or court in accordance with Australian law.
13. Governing law
These terms are governed by the laws of New South Wales, Australia, and are subject to the jurisdiction of the courts of New South Wales.
Nothing in this clause limits your rights to bring proceedings in any other court of competent jurisdiction.
14. Payment processing
Payments are processed by Lemon Squeezy, which acts as the Merchant of Record for transactions. Lemon Squeezy handles payment processing, billing, and tax collection on our behalf.
We do not receive or store your credit card details. Lemon Squeezy's own terms of service and privacy policy apply to payment transactions.
